Jolt For UP Congress President Ajay Rai, Allahabad HC Rejects Plea To Cancel Gangster Act Case

Prayagraj, May 18 (TNA) The Allahabad High Court has said that the Gangster Act is a special criminal law that cannot be abolished based on agreement. The court said that although a settlement has been reached between the complainant and the accused for offences under the Indian Penal Code, it will not have any impact on the offence under the Gangster Act.

Along with this, the petition of Congress leader Ajay Rai and four others, demanding cancellation of the ongoing trial case under the Gangster Act registered at Chetganj police station in Varanasi, has been rejected. This order has been given by Justice Sanjay Kumar Singh.

The High Court said that the Gangster Act case has been instituted by the State Government and not on the complaint of the complainant. It is an independent crime which cannot be ended by compromise. There is no legal provision by which case proceedings can be interfered with. An FIR was registered on 26 March 2010 against a total of 6 people including the petitioners. The police filed the charge sheet on 28 October 2011.

Even before this, the validity of the charge sheet was challenged which was rejected by the High Court. Statements of witnesses are being recorded in the trial. Meanwhile, on 28 September 23, when a settlement was reached between the complainant and the accused, this petition was filed demanding closure of the case proceedings. There is a history of 19 crimes against petitioner Ajay Rai.

The government lawyer said that there is a history of a total of 27 criminal cases against former MLA Ajay Rai. A chart was also filed. After all the arguments, the Allahabad High Court rejected Ajay Rai's petition.
