Ajay Mishra To Be The New Advocate General Of Uttar Pradesh

Lucknow, May 10 (TNA) Senior Supreme Court advocate Ajay Mishra has been named by the Yogi Adityanath government as the new advocate general of the state. He hails from Deoria. The Lucknow Bench of the Allahabad High Court (HC) had on May 7 expressed its displeasure at the non-appointment of a new Advocate General even after a month and has observed that this was a very piquant situation which cannot be accepted at any cost.

The court ordered the government to appoint an advocate general by May 16. This order was passed by the division bench of Justice Devendra Kumar Upadhyay and Justice Subhash Vidyarthi, taking suo motu cognizance of the matter.

The court had said that under Article 165 of the Constitution, there is a provision for the appointment of the Advocate General, under which he not only had to act as a legal advisor to the government but he also has to discharge CrPC, Contempt Act as well as other legal obligations.

And these obligations cannot be transferred to any Additional Advocate General or others, the HC had said. In such a situation, the post of Advocate General cannot be kept vacant as per the constitution. It is noteworthy that Advocate General Raghavendra Singh has submitted his resignation to the government a month back.
