External Examination Alone Not Sufficient Proof Of Someone Being Drunk: Allahabad HC

Prayagraj, December 13 (TNA) External examination alone is not sufficient proof of someone being under the influence of alcohol, the Allahabad High Court (HC) has said. The court, while hearing a case, said that mere external examination of a person is not sufficient evidence to prove that he was under the influence of alcohol.

With this comment, a two-member bench of Justice Soumitra Dayal Singh and Justice Anish Kumar Gupta also passed an order to reinstate the constable in police service. The court was hearing the petition of police constable Jaimangal Ram. He was dismissed for being drunk and inappropriate behavior while on duty. The court also said that it laid emphasis on blood and urine tests to confirm the intoxication of a person.
