Victim Under SC-ST Act To Return Govt Financial Assistance If Agreement Done To Terminate Case: Allahabad HC

Prayagraj, March 1 (TNA) The Allahabad High Court in an important decision has said that if the criminal case under SC-ST Act is terminated on the basis of agreement, then the victim will have to return the financial help received from the government.

The court said that no one has the right to make money from the government by complaining about atrocities against him. In case of a non-pressure agreement, the money received from the government will have to be returned. This is tax payers hard earned money, the court observed.

The court gave this order while hearing four criminal appeals from different courts. The court directed the victims to deposit the amount received from the government in the treasury through the Social Welfare Department within 20 days and after verifying it, passed the appropriate order to the court.

Justice Rahul Chaturvedi has given this order on the criminal appeal of Jhabbu Dubey alias Pradeep Kumar Dubey, Vishwanath Yadav and others, Dharmendra alias Bauva Bajpai and others, Rakesh and others.

The appellants had filed an application demanding to end the case that a settlement had been reached between the parties. The first case is of Lalitpur police station Jakhaura. A case of SC, ST Act was registered regarding the incident of assault. Similarly there are other cases. The court has ordered to send a copy of the order to the sessions courts to follow it in future.
