Varanasi And Hampirpur DM’s Get One Last Chance In Contempt Of Court Case

Prayagraj, June 20 (TNA) The Allahabad High Court (HC) has given one last chance to the district magistrate of Hamirpur and Varanasi in a matter of contempt of court. A petitioner Kumari Shraddha filed an application against District Magistrate Varanasi S. Rajalingam for contempt of the High Court bench's order to dispose of the representation on February 7.

Petitioner's advocate Chandra Prakash Srivastava said that the petitioner had applied in August 2022 to issue the nearest relative certificate in Tehsil. The indifference and negligence of the administrative officers of Uttar Pradesh in complying with the orders passed by the High Court is not only causing problems for the common man but also increasing the number of pending cases in the High Court. Litigants are forced to file contempt cases even before the summer bench of the High Court.

Two similar petitions have been filed against the District Magistrates of Varanasi and Hamirpur. However, the High Court has provided one more chance to both the officers. In this sequence, the petitioner Kumari Shraddha filed an application against District Magistrate Varanasi S. Rajalingam for contempt of the High Court bench's order to dispose of the representation on February 7.

Petitioner's advocate Chandra Prakash Srivastava said that the petitioner had applied in August 2022 to issue the nearest relative certificate in Tehsil. On its non-release, the petitioner had filed a writ in the month of February, the writ court had passed an order to the District Magistrate, Varanasi to dispose of the pending application of the petitioner in six weeks from August 2022, but the District Magistrate did not comply with the order of the writ court within the prescribed period. Did not comply, against which the petitioner took refuge in the summer court.

In the light of the representation of the petitioner, the High Court had ordered to dispose of the complaint in two weeks. But the District Magistrate Hamirpur did not comply with the time bound order of the Writ Court. Compelled by this, the petitioner filed a contempt case against the District Magistrate before the Summer Court.

While hearing both the above contempt applications, Justice Kshitij Shailendra has given an additional opportunity to District Magistrate Varanasi and District Magistrate Hamirpur to comply with the order of the court. Along with this, DM Varanasi has been ordered to file an affidavit with compliance report in the court on July 27 and DM Hamirpur on July 18.
