Proceedings Of Gangster Act Can Be Done Without A Registered Case: Allahabad HC

Prayagraj, Sep 15 (TNA) In an important development, the Allahabad High Court has ruled that action can be taken under Gangster Act even without registering the case. On Hindi Diwas, Justice Saurabh Shyam Shamsheri delivered this verdict in Hindi while hearing a case on Wednesday. The High Court said that even if no offense has been registered in the past, action can still be taken under the gangster act.

The court said that for prosecution proceedings it is not necessary that an FIR should be registered and a gang table should be prepared. The HC further said that even though no one is able to muster the courage to file an FIR out of fear, if the activities of a criminal are coming under the definition of gang, then prosecution proceedings can be taken under the gangster laws without registering any case.
