Once Admitted As Covid Patient, Irrelevant If Death Occured For Other Reasons: Allahabad HC

Prayagraj, July 31 (TNA) The Allahabad High Court has ruled that once admitted as a covid patient, whatever be the cause of death later, the death will not be deemed to have been caused by any other disease, whether due to cardiac arrest or any other organ failure.

The court also ordered that payment to victims should be made within 30 days and if not given, it will draw an interest of 9 percent interest. The Court also said that setting time limit for death from Corona was not right. Allowing the writ petitions filed by Kusum Lata Yadav and several others, a division bench of Justice AR Masoodi and Justice Vikram D. Chauhan directed the state authorities to pay the ex-gratia amount to the dependents of the Covid victims within a period of 30 days.

The High Court has ordered the government to also pay Rs 25,000 to each petitioner who filed the petition. The court has given this order for the petitioners allowing the claims. The petitioners had primarily challenged Clause 12 of the Government Order (Mandate) dated 1st June, 2021.
