Employees Regularized After Implementation Of The New Pension Scheme Also Entitled To Old Pension: Allahabad HC

Prayagraj, April 27 (TNA) The Allahabad High Court has said that the daily wage workers of the already working in Jal Sansthan, whose services have been regularized after the implementation of the new pension scheme in 2005, will also be entitled to get the old pension.

Along with this, the court has directed to give the benefit of old pension to the daily wage workers of Jal Sansthan, who have been regularized later, linking their earlier service with regular service. Justice Vivek Chaudhary has given this order on the petition of Ranveer Singh and 23 others.

The petition said that the petitioner is a regular employee of Jal Sansthan Jhansi. He has been regular between 2005 and 2011. Earlier, between 1989-91, he was appointed as a daily wage worker. He was denied benefits under the old pension scheme by the order of the General Manager of Jal Sansthan Jhansi because his service has been regularized after the implementation of the new pension scheme in the year 2005.

The court said that some of the petitioners have retired and some are still serving. Order should be given to give the benefit of the old pension scheme to all of them adding the services rendered as daily wage earners. The court has directed to give the benefit of old pension in three months, considering the service of daily wage workers as qualifying service.
