Dr. Kafeel Khan Approaches Allahabad HC Against His Continued Suspension, UP Govt Asked To Explain By August 5

Lucknow, August 2 (TNA) Suspended paediatrician of the Baba Raghav Das Medical College in Gorakhpur, Dr Kafeel khan has in the Allahabad High Court (HC) challenged his suspension doom services by the state government on August 22, 2017 blaming him for the oxygen tragedy in which many infants had died. The matter was heard on July 29 but the big judgement was uploaded on the HC website on Monday.

Khan has been absolved of Medical negligence and corruption charges by enquiry officer on April 15, 2019 but the Uttar Pradesh government ordered re-enquiry on February 24, 2020.

After hearing arguments by Khan’s advocates Manish Kumar Nigam and Manoj Kumar and Standing Counsel of Uttar Pradesh Justice Yashwant Varma agreed that Dr Kafeel has approached this Court earlier by filing Writ-A No.3511 of 2019 and court on March 7, 2019 and had ordered Uttar Pradesh to conclude the enquiry within three months.

The High Court has now ordered the Uttar Pradesh government to justify the continuance of the order of suspension which has continued for more than 4 years and submit it reply by August 5.

The Court was informed that pursuant to that direction the Enquiry Officer submitted his report on 15 April 2019. The disciplinary authority however chose to pass the impugned order after almost 11 months. When asked about the delay in taking further action on the part of the disciplinary authority, it was not explained to the court.

The High Court has now ordered the Uttar Pradesh government to justify the continuance of the order of suspension which has continued for more than 4 years and submit it reply by August 5.

Dr Kafeel was suspended after BRD oxygen tragedy which killed 63 innocent children after sudden stoppage of liquid oxygen supply. All other accused who were suspended along with him have been reinstated except him despite getting a clean chit in many enquiries.
