Allahabad High Court Stays GST Recovery Of Rs 1081 Crores From Paytm

Prayagraj, January 24 (TNA) The Allahabad High Court has stayed GST recovery of Rs 1081 crore against Paytm. Along with this, the date of April 27 has been fixed for the hearing of the case. This order has been given by the division bench of Chief Justice Rajesh Bindal and Justice JJ Munir while hearing the petition of One 97 Communications Limited.

The dispute is whether the supply of mobile recharge coupons and direct to home recharge vouchers by Paytm should be treated as state or inter-state. It was stated on behalf of the petitioner that the tax due on their behalf has already been paid in Uttar Pradesh.

As per section 19 of the Integrated Goods and Services Tax Act, 2017, any amount of tax wrongly paid can be adjusted. No interest is paid for such transactions as per section 77 of the Central Goods and Services Tax Act 2017.

The petitioner has made a representation to the Central Board of Indirect Taxes and Customs in this matter which is currently pending. The department argued that a decision should be taken in three months considering the representation made by the petitioner. On this, the court fixed the date of April 27 for hearing.
