Allahabad HC Might Today Pronounce Verdict On Demand For ASI Survey Of Shahi Idgah Mosque Of Mathura

Prayagraj, December 14 (TNA) Will there be ASI survey of Shahi Idgah Mosque of Mathura or not? Allahabad High Court may give important decision on Thursday. 'Lord Shri Krishna Virajman' and 7 others had filed this petition through senior lawyers Hari Shankar Jain, Vishnu Shankar Jain, Prabhash Pandey and Devaki Nandan. It was claimed that the birthplace of Lord Shri Krishna is below the mosque and there are many signs which establish that the mosque was a Hindu temple.

The Allahabad High Court is likely to give its verdict at 2 pm today on a petition seeking appointment of a court-monitored Advocate Commissioner for the survey of the Shahi Idgah complex adjacent to the Shri Krishna Janmabhoomi temple in Mathura. Justice Mayank Kumar Jain, after hearing the concerned parties, had reserved the order on the application on November 16. The application was filed in the case pending before the High Court in connection with the Krishna Janmabhoomi-Shahi Eidgah Mosque dispute.

'Lord Shri Krishna Virajman' and 7 others had filed this petition through lawyers Hari Shankar Jain, Vishnu Shankar Jain, Prabhash Pandey and Devaki Nandan. It was claimed that the birthplace of Lord Shri Krishna is below the mosque and there are many signs which establish that the mosque was a Hindu temple. According to the Hindu side, 'In the application it was submitted before the Allahabad High Court that there is a lotus shaped pillar present there which is a specialty of Hindu temples.

Petition demands ASI survey of Shahi Idgah Mosque

Apart from this, there is also an image of 'Sheshnag', who is one of the Hindu deities. He had protected Lord Krishna on the night of his birth. It was also submitted in the court that there are Hindu religious symbols and carvings on the lower part of the pillars of the mosque. The applicant has requested the Court to appoint a commission with specific directions to submit its report after surveying the Shahi Idgah Mosque within some stipulated period.

On the lines of Ayodhya Janmabhoomi dispute, the trial of Mathura dispute is being held in Allahabad High Court. Allahabad High Court is directly hearing all the 16 petitions transferred from Mathura District Court. In the petitions, the agreement signed on October 12, 1968 has been declared illegal. Under this agreement, a demand has been made to hand over the 13.37 acres of land given to the Shahi Idgah Mosque to Lord Shri Krishna Virajman.

Allahabad HC is looking at all the cases related to this matter

The petitioners had also demanded from the Allahabad High Court to direct photography and videography of the entire proceedings of the ASI survey of the Shahi Igah Mosque. In May this year, the Allahabad High Court had transferred to itself all the cases related to the Shri Krishna Janmabhoomi-Shahi Eidgah Masjid dispute pending before the Mathura court.

On behalf of the Hindu side, Shri Krishna Virajman Temple, a demand was made to the court to appoint a court commissioner and conduct a survey of the disputed premises. In which a demand was made to appoint three member court commissioners for the survey. Along with this, a demand was made in the application to survey the disputed premises and submit the Advocate Commission report to the court. This application was filed under Order 26 Rule 9.

The hearing on the application of the Hindu side to get the survey of the disputed premises done by the Court Commissioner has ended. Now all the 16 petitions related to the Mathura dispute will be heard together in the High Court.

At present, a reply to this application was filed in the court by the Shahi Idgah Mosque. During this, Shahi Idgah Mosque said that until the matter of Places of Worship Act and Waqf Act is not resolved, the decision on the petition demanding the Court Commissioner cannot be taken.

While presenting the arguments in the court on behalf of Shri Krishna Virajman, advocate Vishnu Shankar Jain said that in the Gyanvapi case also, the court commissioner was first appointed and only after that the petition of 7(11) was decided. Apart from this, many cases of the Supreme Court were also cited.

During this, he said that the Supreme Court has also said in its decisions that the petition of 7(11) can be decided at any stage. Advocate Prabhash Pandey and Anil Singh Bisen also presented their views on behalf of the Hindu side.

The petitions have also demanded removal of the illegally built Shahi Idgah Mosque. So that like Ayodhya, a grand temple can be built in Mathura also. The leading suit has been filed in the High Court on behalf of Ranjana Agnihotri and seven others in the name of Lord Shri Krishna Virajmaan Katra Keshav Dev.

A total of four parties have been made in the petition. Shahi Idgah Mosque, UP Sunni Central Waqf Board, Shri Krishna Janmabhoomi Seva Sangh and Shri Krishna Janmabhoomi Sangh have been made parties.
