Adult Couples Have A Constitutional Right To Live Together On Their Sweet Will : Allahabad HC

Prayagraj, Nov 22 (TNA) The Allahabad High Court has said that a live in relationship has been given legal recognition and that an adult couples have the constitutional right to live together of their own free will. No authority or person has the right to interfere in their lives, the HC said further.

The court has quashed the FIR registered at Narhi police station in Ballia against the petitioners living in live-in relationship. This order has been given by the division bench of Justice Sunit Kumar and Justice Syed Waiz Miyan while accepting the petition of Akash Rajbhar and others. In the petition, a demand was made to quash the registered FIR as per the judgment of the Supreme Court in Shafin Jahan vs. Ashokan KM and others.

The court quoted the Supreme Court as saying that no one's personal liberty can be taken away without legal authority. “Adult couples have a constitutional right to live together of their own free will. It is the responsibility of the government to protect their right. Adults have the right to choose a life partner of their choice and live together. They cannot be deprived of this right” the HC bench observed.
