Thorough Probe Before Registering An FIR On Civil Matters Against Businessmen, Entrepreneurs: DGP HQ Missive To All Cops

Lucknow, August 19 (TNA) In a decision that is likely to go a long way in giving a philip to ease of doing business in the state, the Uttar Pradesh DGP Headquarters has issued strict orders to all police officers to ensure that cases against entrepreurs, businessmen, educational institutitions and hospital managements are only registered after a threadbare probe into the complaint.

It has been said in these instructions that in such cases which are of civil nature, related to commercial disputes, accidental accidents, preliminary investigation will be done before registering a case (FIR) as per the instructions of the Supreme Court.

The DGP HQ guidelines are being viewed also as a preventive tool to ensure no harassment of entrepreneurs, businessmen, educational institutions, hospitals, builders, hotel and restaurant owners and management level employees.

Special DG Law and Order and Crime Prashant Kumar said that in order to speed up the development works of the state, there should not be any hindrance in the direction of Ease of Doing Business, for this all important institutions, establishments like medical, education, In case of accidental accident in manufacturing etc., before registering FIR, it will be ensured whether the person named in the application has a direct relation with the incident or not. Also, the accused has not been named due to commercial rivalry, dispute, arbitrariness.

The DGP Headquarters has clarified that the sole objective of issuing these instructions is to reduce the tendency of registering FIRs by giving criminal color to disputes of civil nature. Along with this, control can be found on the habitual complainants who register FIRs by misusing the judicial process.

With this, adverse environment for the investors will be avoided and the state will get more investment. At the same time, it has also been clarified that the purpose of these instructions is never that investigation will be conducted in every case of cognizable offence. In such cases, in which the existence of cognizable offense is clear from the complaint application, FIR will be registered immediately as per the directions of the Supreme Court.
